Makurdi
A Makurdi High Court, presided by Justice Wilfred Kpochi,has dismissed an interlocutory application by APC; seeking to stop the Benue State Independent Electoral Commission, BSIEC from conducting the Local Government Election, scheduled for twenty eighth of this month.
Kpochi stated that it was late for the court to restrain the state election umpire body from conducting the exercise, pointing out that election matters are time bound while preparations for the Local Government polls was already in advance stage.
The High Court Judge noted that the recent judicial trend forbid granting of exparte injunctions in election matters unless for emergency reasons.
He faulted the applicant for waiting patiently since the notice for the election was made public last December, only for her to filed the application when the election day is near.
He, however, accepted to give accelerated hearing of the substantive suit and adjourned it to April 9 for hearing
The judge directed that the Respondents, including BISIEC and the Attorney General and Commissioner for Justice to be served with the notice promptly.
