A lawyer, Mr. Balla Dakum, has threatened to initiate contempt proceedings against the Minister of the Federal Capital Territory (FCT), Nyesom Wike, over the alleged demolition of a disputed property in Maitama District, Abuja, despite a subsisting court order.
Dakum, who addressed judiciary correspondents in Abuja on behalf of his client, Alhaji Abubakar Ibrahim, Chairman of Mykas Grid Ventures Ltd, described the development as troubling and a potential breach of the rule of law.
Our correspondent reports that the property in dispute, located at Plot No. A06/4583, Maitama, was reportedly affected on Tuesday morning when officials of the FCT Development Control Department allegedly demolished its fence and security post, purportedly on the minister’s directive.
According to Dakum, the action was taken despite a valid court order directing all parties to maintain the status quo.
“We convened this press briefing to address a deeply concerning development involving the Honourable Minister of the FCT.
“Despite being duly served with court processes and an order of a competent court directing parties to maintain the status quo, the minister allegedly proceeded with the demolition of the fence on the disputed property,”he said.
He emphasised that court orders are binding on all parties, irrespective of their status or position.
“The rule of law remains the cornerstone of our democracy. No individual, regardless of office, is above the law. Court orders are not mere suggestions; they are enforceable directives backed by law,” Dakum stated.
The lawyer further alleged that more than 50 armed policemen accompanied officials to the property to enforce the action, claiming that the land had been reallocated to Italia Company Limited without prior formal notice to his client.
Dakum disclosed that his legal team would apply for Form 48, a notice of consequences of disobedience to court order, as a preliminary step toward initiating contempt proceedings.
He noted that the minister is a lawyer and a member of the Body of Benchers, stressing that his team would pursue redress strictly through legal channels.
He also called on President Bola Tinubu to intervene and caution the minister against actions that may be perceived as disregarding judicial authority.
In his remarks, Alhaji Ibrahim said he was originally allocated the 1.5-hectare plot in 2006 when Nasir El-Rufai served as FCT Minister, adding that the land size was later reduced to 8,572.60 square metres following a redesign to accommodate parking space for As-Salam Mosque.
He alleged that in November 2025, the land was reallocated to an Italian company without his consent, prompting him to seek legal redress.
Ibrahim further claimed that shortly before the demolition, he received a phone call from a security operative instructing him to vacate the property.
“They did not allow me to remove my belongings. My trucks were moved without any inventory being taken,” he alleged.
He expressed concern that the demolition allegedly occurred despite an order issued on February 10 by Justice H. Mu’azu of the FCT High Court, Maitama, directing parties to maintain the status quo pending the hearing of a motion on notice.
The order was granted following an ex parte motion marked M/16354/2025 and moved by Hussaina Tukur, counsel to the applicant. The matter has been adjourned until April 23, 2026, for hearing.
In the motion dated December 5, 2025, Mykas Grid Ventures Ltd sued the FCT Minister and Italia Company Ltd as first and second defendants, seeking an interim injunction restraining them from taking possession of Plot No. A06/4583, also known as Park 2023, pending the determination of the substantive motion.
