The Federal High Court in Abuja has refused an application seeking to restrain former Senate President, David Mark, and ex-Osun State Governor, Rauf Aregbesola, from assuming leadership positions in the African Democratic Congress (ADC).
Justice Emeka Nwite, in a ruling delivered on Thursday declined the three prayers sought in an ex-parte motion filed by Mr. Nafiu-Bala Gombe, a former Deputy National Chairman of the ADC, through his counsel, Michael Agber.
Rather than granting the interim orders, the judge directed Gombe, who is the plaintiff, to put all defendants on notice to show cause why the application should not be granted.
The matter was adjourned to September 15 for hearing.
Our correspondent reports that Mark currently serves as the national chairman of the ADC, while Aregbesola is the party’s national secretary.
In the suit marked FHC/ABJ/CS/1819/2025, Gombe listed the ADC, Mark, Aregbesola, the Independent National Electoral Commission (INEC), and Chief Ralph Nwosu as first to fifth defendants.
In his ex-parte motion dated September 2, Gombe sought three reliefs:
An interim injunction restraining INEC from recognising Mark and Aregbesola as national chairman and secretary of the ADC pending hearing of the substantive motion.
An interim order barring Mark, Aregbesola, and their supporters from parading themselves as national officers of the party.
An order restraining INEC from dealing with them in those capacities until the motion on notice is determined.
