Former President of the Nigerian Bar Association,NBA, Mr.Joseph Daudu, SAN,has condemned the decision to charge minors with treason in Abuja.
In a statement he signed and availed the public, and a copy to The Reporters on Sunday in Lokoja, kogi state,he noted that many of the defendants are under 16 years old, arguing that rendering such charges is excessive and inappropriate.
After the minors’ arraignment at the Federal High Court, Daudu emphasized that they could have been charged with lesser offenses like unlawful assembly or public property destruction, which are typically bailable and more fitting for juvenile or magistrate courts in the states where the alleged misconduct occurred.
Daudu asserted that the conduct of the minors did not meet the threshold for treason, pointing out that they had already endured three months of harsh detention conditions, which he condemned as a violation of their fundamental rights.
He further argued that, even if the minors were guilty of the alleged offenses, the penalties should not exceed reasonable fines or short-term confinement in appropriate facilities.
The SAN called for the federal government to discontinue the charges and release those accused, advocating for rehabilitative measures and compensation for their unjust treatment.
He also raised concerns regarding the accountability of those responsible for the minors’ custody, questioning how allocated funds were utilized and the overall conditions they faced while detained.
He urged a comprehensive inquiry into the matter, suggesting that it reflects deeper systemic issues within Nigeria’s governance and its commitment to civil rights.
Daudu stressed the urgent need for reforms that protect citizens’ rights and underscore the importance of a functioning legal system in a democratic society.
